Terms and Conditions – The Competition Hive

1. Introduction

Welcome to The Competition Hive ( “the Promoter”, “we”, or “us”). These Terms and Conditions govern the use of the website competitionhive.co.uk ( “the Website” ) and participation in any prize competitions (“Competition” or "Competitions") operated by The Competition Hive. By creating an account or entering any Competition on our Website, you (the “Entrant” or “you”) agree to be bound by these Terms and Conditions.

Skill-Based Competitions (Not Gambling): All our Competitions are skill-based prize competitions that require entrants to demonstrate skill, knowledge, or judgment by correctly answering a competition question. They are not lotteries or games of chance, and The Competition Hive is not a gambling platform. Our Competitions are intended to comply with the legal requirements of the Gambling Act 2005 for prize competitions and free draws gamblingcommission.gov.uk. This means no gambling license is required, and entry fees are for the opportunity to participate in a skill contest. There is no free entry route available; a paid entry is required for each Competition. However, because a correct answer to a skill question is required for a chance to win, these promotions are exempt from lottery laws. Any reference to "we" or "us" in these Terms means The Competition Hive. Any reference to "Prize" means the reward offered in a particular Competition (whether cash, goods, or experiences).

Please read these Terms carefully before participating. If you do not agree, you should not use the Website or enter the Competitions. We reserve the right to update or modify these Terms from time to time. The version posted on the Website at the time of your entry will govern that entry. These Terms apply to all Competitions on the Website (in conjunction with any specific rules stated for individual competitions), and they cover the entire usage of the Website.

2. Eligibility

To maintain fairness and legal compliance, all Entrants must meet the following eligibility criteria:

  • Age: You must be 18 years of age or older to register an account and enter any Competition. Competitions are not open to minors under any circumstances. We reserve the right to request proof of age (such as government-issued ID) from any Entrant or winner. If a winner is found to be under 18, they will be disqualified and forfeit their prize.

  • Residency: Competitions are open only to residents of the United Kingdom (including England, Scotland, Wales, and Northern Ireland). Entries from outside the UK are not eligible. It is the Entrant’s responsibility to ensure that participating in our Competitions is legal in their jurisdiction. The Promoter will not be liable if an individual enters from a jurisdiction where such competitions are unlawful (such entries will be void).

  • Personal Eligibility: Only natural persons (individual human beings) using their own personal account may enter. One account per person is permitted. Multiple accounts by the same individual, or accounts opened with disposable/temporary email addresses, are not allowed. If we detect duplicate accounts or false identities, we reserve the right to suspend or close those accounts and disqualify any associated entries.

  • Employees and Family: Employees, agents, or contractors of The Competition Hive, as well as their immediate family members or members of their households, are not eligible to enter any Competitions. We also may exclude any persons professionally connected to the Promoter or the administration of the Competitions.

  • No Bots or Automated Entries: Entries must be made by the individual entrant manually through the Website. Any form of automated entry, use of scripts, bots, macros or any other robotic or artificial means to participate is strictly prohibited. If we suspect an entry was made using automated means or in any way that gives an unfair advantage, that entry (and possibly all entries by that Entrant) will be disqualified.

  • No Cheating or Manipulation: Entrants must not attempt to influence the outcome of a Competition through any unfair methods. This includes collusion, hacking the Website, exploiting vulnerabilities, using false information, or any fraudulent behavior. The Promoter reserves the right to disqualify any Entrant if we have reasonable grounds to believe the Entrant has violated these Terms or attempted to cheat or undermine the fairness of the Competition.

  • Account Requirements: To be eligible, Entrants must register for an account on the Website and provide accurate, current contact information (full name, date of birth, postal address, email, phone number). By entering, you confirm all information supplied is truthful and complete. The Promoter may at any time require proof of identity and eligibility. Failure to provide requested proof or providing false details will result in disqualification (and potential account termination). Each individual is responsible for maintaining and updating their contact details in their account.

By entering any Competition, you represent and warrant that you meet all eligibility requirements. The Promoter reserves the right to refuse entry or disqualify any entrant (before or after draw) if eligibility criteria are not met or if these Terms have been breached. No refunds will be given for entries that are disqualified due to violation of these Terms (including ineligibility or cheating).

3. Account Registration

In order to participate in Competitions, you must create an account on the Website:

  • Sign-Up: To register, provide the required details (full name, date of birth confirming you are 18+, a valid email, phone number, and postal address). You will also create a secure password. You are responsible for keeping your login details confidential and secure. Do not share your account with others.

  • One Account Policy: As noted, only one account is allowed per person. Creating multiple accounts (under different emails or identities) is not permitted. If we find that you have multiple accounts, we may suspend or terminate all associated accounts and void any entries or winnings.

  • Account Verification: We may verify the information you provide at registration or before prize delivery (including age and identity verification). We may perform checks (for example, requesting copies of ID or utility bills) to ensure information is accurate. By registering, you consent to such verification checks.

  • Accuracy of Information: You agree to provide truthful, accurate, and up-to-date information. If any of your details change (e.g., contact number or address), you should update your account promptly. The Promoter is not responsible for communication failures or prize delivery issues due to outdated or incorrect contact details in your account.

  • Account Integrity: If you suspect any unauthorized use of your account or a security breach (e.g., your password is compromised), you must notify us immediately at admin@competitionhive.co.uk. We are not liable for any loss or unauthorized entry if you fail to secure your account or inform us of a breach. We reserve the right to disable or delete accounts that we suspect are compromised, fraudulent, or violating these Terms.

Using the Website and creating an account also signifies your agreement to abide by any Website usage policies or Privacy Policy (which covers how we handle your personal data – see Section 10 below). The Promoter may refuse to register an account or may close accounts at its discretion if any misuse or violations occur.

4. How to Enter a Competition

When a Competition is live on our Website, eligible users may enter by following the process below. Please note that each Competition may have specific details (prize details, ticket price, closing date, etc.) posted on its page, which form part of these Terms. In general, the entry process is:

  1. Select a Competition: Browse the list of current (live) Competitions on the Website and choose the prize you are interested in. Each Competition page will display important details such as the prize description, entry fee (ticket price), any maximum number of entries allowed, the closing date/time, and the skill-based question or task required.

  2. Answer the Skill Question: Before you can purchase an entry, you will be presented with a skill-based question or problem related to the Competition. This question must be answered to proceed. You must answer the question on your own without any assistance. Make sure to double-check your answer before submission. Only entrants who answer the Competition question correctly will have a chance to win the prizelucky4ucompetitions.co.uk. (See Section 6 for more on the skill requirement.)

  3. Purchase Entry/Entries: After answering the question, you will be prompted to buy your entry (or entries). Each entry corresponds to one chance to win in the prize draw (subject to answering correctly). The entry fee (ticket price) for each Competition will be clearly stated on the Website. You may purchase the number of entries you desire (up to any specified entry cap – see Section 5) by following the on-screen instructions and making payment. Entries are only confirmed once payment is successfully processed.

  4. Payment: Payment for entries must be made via the approved payment methods on our Website (e.g., credit/debit card or other stated methods). All payments are handled securely. By entering payment details, you confirm that you are authorized to use that payment method. Entry fees include any applicable VAT (if any) and are in GBP (£). You will receive a confirmation (on-screen and/or by email) when your payment is received and your entry is recorded.

  5. Entry Confirmation: Upon successful entry, you will be assigned an entry number or ticket number for each entry. This number is typically used to identify your entry in the draw. All entry numbers purchased will be recorded in our system and may be viewable in your account or an entry list. It is your responsibility to ensure you have received confirmation of your entry. If you do not receive any confirmation email within a reasonable time after purchase, please contact us to confirm whether your entry was received.

  6. Deadlines: All entries must be received by the closing date and time specified for that Competition. The closing date/time will be clearly stated on the Competition page (and is usually also in the confirmation email). All time references will be to UK local time (GMT or BST as applicable). Late entries will not be accepted. If you attempt to enter after a Competition has closed (or after it sells out), your entry will be disqualified and no refund will be given for a late entry, so please ensure you enter before the deadline.

  7. Sold-Out or Early Closure: Each Competition may have a maximum number of entries (tickets) available. Once the maximum number is reached, no further entries will be accepted. We may also close a Competition early if all tickets sell out before the closing date. In such cases, we will conduct the draw earlier than the original closing date, and we will notify all participants of the new draw date (for example, via announcement on the Website or social media). Conversely, if a Competition does not reach a minimum number of entries, the Promoter reserves the right to extend the closing date or otherwise adjust the Competition (see Section 5 below).

By completing the steps above and entering a Competition, you are making a commitment to purchase the entry/entries and participate. All entry fees are non-refundable, except in the specific circumstances stated in these Terms (such as if The Competition Hive cancels the Competition). Please ensure you understand the Competition details and these Terms before entering, as we want everyone to have a fair and enjoyable experience.

5. Entry Fees and Ticket Limits

Each Competition on The Competition Hive requires payment of an entry fee. Below are the rules regarding fees and any limits on entries:

  • Entry Fee: The price of each entry (“ticket”) will be clearly specified on the Website for each Competition. Entry fees can vary per Competition depending on the prize and the number of entries available. By entering, you agree to pay the stated fee for each entry. Payments are charged at the time of entry. All fees are in GBP and inclusive of taxes where applicable. There are no hidden charges beyond the ticket price.

  • No Free Entry Route: There is no free entry route for our Competitions. Entry must be obtained via paid purchase on the Website. As explained, since each Competition involves a skill question to determine eligibility, this is legally a prize competition and not a lottery, hence a free entry route is not required under UK law.

  • Number of Entries per Person: To keep things fair, there may be a maximum number of entries one person can make in a given Competition (“ticket cap”). The maximum is usually stated on the Competition’s information page (e.g., “Max 20 entries per person”) if applicable. The Promoter reserves the right to set or adjust entry limits per person for each Competition. If you purchase more entries than the allowed cap (or attempt to do so via multiple accounts, which is prohibited), the excess entries will be disqualified and not entered into the draw (and no refund will be given for such entries). Typically, if no specific per-person limit is stated, you may enter as many times as you wish until the Competition closes or sells out. We encourage responsible participation; buying more entries does not guarantee success and should be done only within your means.

  • Total Tickets/Entries Available: Each Competition has a set total number of entries available (e.g., a competition might have 1000 tickets total available). This number will be advertised. Once the maximum number of tickets is sold, the Competition will close to further entries (even if the official closing date hasn’t arrived yet). We do not typically extend competitions or increase the number of tickets beyond what is originally stated. In rare cases where a Competition is undersubscribed (fewer entries sold than expected), the Promoter reserves the right to extend the closing date for a reasonable period or cancel the Competition (see next bullet). Any extension will be communicated clearly on the Website and will be for a limited additional time. We will not extend any Competition more than a reasonable number of times (and never indefinitely).

  • Cancellation or Extension: While it is our intention to run every Competition as scheduled, the Promoter retains the right to cancel or amend a Competition if circumstances outside our control make it unavoidable (e.g., technical failures, fraud attempts, or insufficient participation that would prevent a valid competition). If a Competition is cancelled for any reason, we will refund all entry fees paid by entrants for that Competition within a reasonable timeframe. If a Competition’s closing date is extended, all existing entries will remain valid until the new closing date; entrants will be notified of the change, and a notice will be posted on the Competition page. We will not extend a Competition purely for the Promoter’s financial gain; any extension would be to ensure a robust competition or due to legitimate issues encountered.

  • No Refund Policy: All entries are final and non-refundable, except if the Promoter cancels the Competition (in which case entry fees will be returned) or as otherwise required by law. By entering, you understand that you are paying for the opportunity to participate in a competition and not purchasing a tangible good or service – thus, statutory consumer cancellation rights (e.g., the 14-day “cooling-off” period for distance sales) do not apply to Competition entries once your participation is confirmedragnarokcompetitions.co.uk. Make sure you wish to enter before completing the purchase, as we cannot refund entry fees if you change your mind, arrive late, or your entry is disqualified due to your breach of these Terms.

6. Skill Question Requirement

The hallmark of The Competition Hive’s promotions is that they are skill-based competitions. Every Competition includes a Skill Question which must be answered as part of the entry process (see Section 4). This section explains the importance and conditions of the Skill Question:

  • Purpose of Skill Question: The Skill Question is designed to ensure that winning is not purely down to chance. Under UK law, a genuine prize competition must rely on skill, knowledge, or judgment so that not everyone can easily answer correctlygamblingcommission.gov.uk. Our questions are intended to be of sufficient difficulty or skill that some people will answer incorrectly or be deterred from entering, thus ensuring the Competition is lawful and not an illegal lotterygamblingcommission.gov.uk. By entering, you acknowledge that the Competition has a skill element and that you must exercise your skill or knowledge to have a valid chance of winning.

  • Answering the Question: You must answer the specific question or problem on the entry form before purchasing your entry. Only one answer submission is allowed per entry purchase. You are not allowed to change your answer once submitted. The question format may vary (could be a multiple-choice question, a puzzle, a logic or math problem, or similar test of knowledge or skill). You should not rely on others for the answer; using search engines or external help may be against the spirit of the competition and, in some cases, against the rules (if explicitly stated). We expect all Entrants to answer to the best of their personal ability.

  • Correct Answers: Only entries with the correct answer to the Skill Question will be eligible to win the prize. If you answer the question correctly and complete the entry payment, your entry will proceed to the prize draw pool for that Competitionlucky4ucompetitions.co.uk. Getting the answer right qualifies you for the chance to win; it does not guarantee that you will win, as there may be many other correct entries and the winner is then determined by a random draw among correct entries.

  • Incorrect Answers: If your answer to the Skill Question is incorrect, your entry will not be valid and will not be entered into the prize draw. In other words, you will lose the chance to win the prize if you answer incorrectly. No refund will be given for entries with wrong answers, since the entry process (including the skill question challenge) still took place. The entry fee is the price for the opportunity to answer the question and participate, not a guarantee of inclusion in the draw. We therefore strongly encourage you to take care when answering. This rule is crucial to maintain the skill-based nature of our Competitions. As a safeguard, our system or staff will typically check the answers, and any entry with a wrong answer will be filtered out prior to the drawragnarokcompetitions.co.uk.

  • Multiple Entries and Answers: If you enter multiple times (where allowed), you must answer the Skill Question each time. We reserve the right to use different questions for different entries or competitions. If the same question is reused, you must answer it each time you participate; repeating a previous correct answer remains subject to being correct for that competition’s question. If you submit different answers on multiple entries, only those entries with the correct answer will count.

  • Publication of Correct Answer: In the interest of transparency, the correct answer to the Skill Question for each Competition will ordinarily be revealed when the Competition closes or at the time of winner announcement. We may publish the correct answer on the Website or announce it during the live draw, so that all participants can see that the competition was fair and the answer was predetermined.

  • Disputes Over Answers: The Promoter’s determination of the correct answer is final. In the unlikely event that a mistake is made in the wording of the question or the evaluation of answers, the Promoter reserves the right to either declare the Competition null and void (with full refunds) or to continue the Competition with an adjusted question/evaluation, at our discretion. Any such issues will be communicated publicly. We assure entrants that questions are set and answers determined in advance to ensure fairness.

By entering, you agree that the skill component is a key part of the Competition. The requirement to answer a question correctly is what differentiates our Competitions from pure chance lotteries. This ensures compliance with UK law and gives all players a fair challengegamblingcommission.gov.uk. The Competition Hive will not accept any liability for Entrants failing to answer correctly, nor can we give any clues or confirmation about answers prior to the draw. Trust that if you answer correctly and follow the rules, you will have an equal chance in the prize draw as all other correct Entrants.

7. Winner Selection Process

Each Competition will have one or more winner(s) as specified (usually a single winner per prize, unless otherwise stated). The process for selecting winners is as follows:

  • Draw Date: The draw for each Competition will take place on the date and time advertised on the Competition page (or earlier if the Competition sells out in advance and we announce an early draw). We strive to hold the draw promptly at the closing time or as soon as possible thereafter. Any changes to the draw date/time (for example, due to extension of the competition or technical delays) will be communicated on the Website and/or via email to entrants.

  • Draw Method: Winner(s) will be selected at random from all eligible entries for that Competition. “Eligible entries” means all entries that were correctly submitted, answered the Skill Question correctly, paid the entry fee, and were not otherwise disqualified prior to the draw. The random draw may be conducted using a computerized random number generator or an equivalent random draw mechanism. We ensure that the draw is fair, impartial, and in accordance with the laws of chanceasa.org.uk. If a computer random generator is used, we keep evidence of its fairness. In some cases, we may draw names or numbers from a physical container (“raffle style”) under the supervision of an independent observer to ensure integrityasa.org.uk. The particular method may vary, but in all cases chance alone determines the winner among the qualified entries.

  • Supervision and Fairness: All draws will be conducted in a secure and transparent manner. The Competition Hive may appoint an independent adjudicator or observer to oversee the draw process, or use a trusted third-party random draw service, to verify that winners are selected fairly (especially for high-value prizes). We will maintain records of the draw results and verification. The Promoter’s decision is final in all matters relating to the draw and winner selection. No correspondence or discussion will be entered into regarding the outcome.

  • Announcement (Live Draws): Where possible, The Competition Hive will announce the draw results live. For example, we may stream the winner selection on Facebook Live or another platform, so that participants can watch the draw in real time. Details of any live draw (date, time, platform) will be provided on the Competition page or via email/social media in advance. We encourage entrants to watch these live announcements for transparency and excitement, but it is not mandatory. After the live draw, the winner’s name (and/or ticket number) will be announced and posted on our Website or social media pages. Even if a draw is not watched live, all Entrants will have access to the results after the fact (posted on the Website’s Winners page or the specific competition page). The Promoter will make available evidence of the draw and winner (such as a recorded video of the draw or a published winners list) so that all participants can be assured the competition was conducted fairly and as advertised.

  • Multiple Prizes or Runners-up: If a Competition specifies multiple prizes or places (e.g., a grand prize and some runner-up prizes), the draw will be adapted accordingly. Typically, the grand prize winner will be drawn first, followed by the runner-up(s). Each entry can win only one prize in the same competition (so if the same entrant’s number is drawn again for a secondary prize, we may redraw to select a different winner for that secondary prize, depending on the competition rules). Any such rules will be clarified in the specific competition details.

  • Odds of Winning: The chance of winning depends on the number of eligible entries received (and the number of entries you have purchased). We do not guarantee any odds to any entrant. However, once the competition closes, we can confirm the total entries and you can calculate your approximate odds. We ensure that each entry has an equal chance in the random draw.

  • Winner Information: After the draw, the Promoter will compile the necessary winner information. We may prepare an announcement including the winner’s first name, possibly last initial or surname, and area of residence (e.g., city or county) to demonstrate a legitimate prize award took place. Public announcement details will respect privacy laws (see Section 11 on Publicity).

The draw and winner selection process is designed to be fair, transparent, and compliant with relevant regulations and advertising codes. Evidence of random winner selection will be available on request if you have any concerns. We take fairness seriously – every Competition will have a winner, and every valid entry is in the running.

8. Prizes

Each Competition has a specific advertised prize (or prizes). Prizes may be cash, physical goods (products), or experiences (such as trips or activities). The following terms apply to prizes:

  • Prize Description: The prize for each Competition will be described on the Website’s competition page. We strive to describe each prize accurately, including make, model, specification, quantity, included elements, etc. Any images of prizes are for illustration purposes; actual prize may vary slightly (e.g., color or model year) but will be of equal or greater value than described. In the case of cash prizes, the amount will be clearly stated in GBP. For experience prizes, details about what is included (and what is not, e.g., travel or accommodations if any) will be provided.

  • Prize Value: We may indicate the approximate retail value of non-cash prizes. This is for reference only. The actual market value may fluctuate. The Promoter makes no guarantee of the prize’s market value at the time of award. No valuations provided shall be binding, and Entrants agree that the opportunity to win the prize is the consideration for entry, regardless of the prize’s ultimate value.

  • No Cash Alternative (Unless Stated): Prizes are generally not substitutable or exchangeable. Non-cash prizes cannot be redeemed for cash by the winner, and no credit or alternative prize will be given, except at the Promoter’s sole discretion. If a cash alternative is explicitly offered in the competition description (or if the Promoter decides, in special circumstances, to offer a cash payout instead of a physical prize), this will be clearly stated. Otherwise, winners are expected to accept the prize as offered.

  • Prize Substitution: In the unlikely event that the advertised prize becomes unavailable or cannot be supplied for reasons beyond our control (e.g., a product is discontinued or an experience provider ceases trading), The Competition Hive reserves the right to substitute the prize with an alternative of equal or higher value. We will endeavor to consult with the winner and choose a satisfactory replacement (or a cash alternative if appropriate). Any substitution will be communicated and agreed upon before awarding.

  • Ownership and Transfer: Title and risk in the prize pass to the winner upon delivery or collection. Until that point, the prize remains the property of the Promoter. The prize is non-transferable by the winner (you can’t sell or assign your win to someone else before it’s delivered). However, after you have received the prize, it’s yours to do with as you wish (subject to any specific restrictions, e.g., you may not be able to resell certain experience vouchers, etc., depending on providers’ terms).

  • Prize Fulfillment – Physical Goods: If you win a physical item (e.g., electronics, toys like LEGO sets, consoles, etc.), the Promoter will coordinate with you to deliver the item to your provided UK address. Delivery within the UK is free of charge to the winner. We will typically dispatch prizes within [14] days of winner confirmation, unless otherwise stated or agreed. Large or heavy items may require special delivery arrangements (we will discuss with the winner). The winner must provide a valid address for delivery and be available to receive it. The Promoter is not liable for any delays in delivery caused by the courier or for any damage to the prize in transit (although we will package securely and insure where appropriate). It is the winner’s responsibility to promptly communicate with us to arrange delivery. If a prize is returned to us due to incorrect address or failure to collect, we will attempt to contact the winner for re-delivery (which may incur costs to the winner if due to their error).

  • Prize Fulfillment – Cash: If you win a cash prize, it will typically be paid via bank transfer or cheque. The Promoter will contact you to arrange a suitable payment method. You may need to provide bank account details. We aim to process cash prize payments within [5-10] working days after winner verification, though external processing times may vary. No fees will be deducted from the stated prize amount; you will receive the full amount.

  • Prize Fulfillment – Experiences: If the prize is an experience (trip, event, activity, etc.), we will liaise with you to provide any vouchers, tickets, or booking information. Some experience prizes might have specific conditions (e.g., age/height/health requirements, available dates, expiration dates for vouchers, etc.). These conditions will either be stated in the Competition details or provided to the winner. The winner is responsible for meeting those conditions (for example, having a valid passport for a travel prize, or adhering to any health & safety instructions for an activity). The Promoter will not be responsible if a winner cannot take up an experience prize due to not meeting requirements or personal circumstances, and in such cases there will be no cash alternative unless we decide otherwise. We will work with winners to schedule experiences at mutually agreeable times if not fixed, but please understand that some prizes may only be available on certain dates.

  • Publicity and Presentation: Occasionally, The Competition Hive (or prize sponsors) may wish to present the prize to the winner in person, or invite winners to participate in a presentation (especially for major prizes). This could involve taking photographs or videos of the winner with the prize. Participation in such publicity is voluntary (see Section 11 on Publicity for details). Refusal to partake in a public award does not forfeit your prize, which can be delivered privately if you prefer.

  • Taxes and Charges: Under current UK law, no income tax or lottery tax is payable on prizes won in skill competitions. The prize is essentially tax-free to UK winners. If any tax or charge were to apply (for instance, importing a prize from abroad might incur customs duties), the Promoter would typically cover standard UK duties for delivering the prize as described. Winners are responsible for any personal tax implications if they are outside the UK or any reporting required by their local authorities. For example, if a UK winner later sells the prize, any subsequent tax consequences are not the Promoter’s responsibility.

  • Warranty and Prize Condition: We will endeavor to supply prizes that are new (or in the condition stated). Any manufacturer’s warranty or guarantee for a product prize will be passed on to the winner. The Promoter does not provide any additional warranty beyond the standard manufacturer or supplier warranty. For used or collectible prizes (if any), the condition will be made clear (“as is” if applicable). The Promoter is not liable for any defects in a prize once delivered, but we will assist in providing purchase receipts or support for the winner to make warranty claims if needed. We are not liable for any injury or damage resulting from use of a prize – for example, we are not responsible if you win a tech gadget and it malfunctions causing damage, but the manufacturer might be under their warranty. Nothing in these terms limits any statutory rights you may have against a product’s manufacturer.

  • No Responsibility for Use: Once a prize is handed over, how it is used is beyond the Promoter’s control. We are not liable for any loss, damage, or injury that occurs to the winner or any other person in the course of using or enjoying the prize (to the fullest extent permitted by law). For example, if the prize is a driving experience, the experience provider’s terms and liability waivers will apply and must be accepted by the winner; the Promoter is not responsible for the conduct of third-party providers. Winners must exercise any due caution and comply with all instructions for prize use.

  • Unclaimed Prizes: If a winner does not or cannot accept a prize (for example, due to scheduling conflicts for an experience, or failing to respond to our communications within the claim period), the situation will be handled as described in Section 9 (Winner Notification and Claim). Generally, unclaimed prizes may be offered to alternate winners or used in future promotions, at the Promoter’s discretion, after all reasonable attempts to contact the original winner have failed.

Every prize is provided in good faith and we truly want winners to enjoy their rewards. The details above are meant to ensure clarity on what winners can expect. If you have any questions about prize specifics, you can contact us (preferably before entering) for clarification. The Promoter’s liability related to prizes is limited as described in Section 12 (Liability).

9. Winner Notification and Prize Claim

Winning entrants will be notified and must claim their prizes in accordance with the following process:

  • Notification Method: The Competition Hive will contact winners directly using the contact information provided on the winner’s account. We typically use email as the primary method, and may also attempt to contact via phone call or text message if a phone number is available. Additionally, we may send a notification via any social media account used for the entry (if applicable) or via postal mail for certain prizes, but email/phone are the main channels. It is important that you keep your contact details up to date (see Section 3) so that we can reach you if you win.

  • Timing of Notification: We aim to notify the winner as soon as possible after the draw. In many cases, if a draw is done live, the winner’s name or ticket number will be announced publicly (which is a form of notification), but we will still follow up with direct contact. Typically, winners are notified within a few hours of the draw, and at most within 24 hours, unless circumstances prevent this. Check your email (and spam folder) around the draw time and thereafter.

  • Winner Announcement: Alongside direct contact, we will usually announce the winner’s first name and perhaps last initial, or a username, on our Website or social media shortly after the draw. For example, we might post “Congratulations to Jane D. from London, winner of the PlayStation 5 Competition!” This public announcement is part of our transparency (and marketing) but will be done in accordance with privacy rules (see Section 11). If you object to any aspect of this being public, you must inform us (see Section 11 regarding your rights). Nonetheless, our default is to announce a winner’s name in a limited form.

  • Winner’s Responsibility: If you are the winner, it is your responsibility to respond to our notification and claim the prize. We will provide instructions in the email or call on what to do next – usually, we will need you to confirm your identity and eligibility (for example, by sending us a copy of your ID and proof of address) and arrange delivery or collection of the prize. We may also ask you to confirm acceptance of the prize in writing (email confirmation is usually fine).

  • Claim Period: Winners typically have [14] days from the first notification date to claim their prize (unless a shorter or longer period is stated for a particular Competition). For example, if we email you and you do not reply within 14 days, the prize may be considered unclaimed. In some cases (like time-sensitive prizes or if explicitly stated in the Competition terms), the claim window could be shorter (e.g., 5-7 days). We will state in the winner notification the deadline by which you must respond. It is very important to act promptly when notified.

  • Failure to Respond: If the initial winner does not respond or cannot be contacted (e.g., emails bounce, no reply, phone disconnected) within the claim period, the Promoter reserves the right to deem the prize “unclaimed”. We will make multiple attempts to contact you via different methods before making such a decision (for example, at least two emails and one phone call/text if possible, over the course of the claim period)asa.org.uk. We may also send a final notice. If there is no response after the claim period expires, the winner forfeits the prize.

  • Alternate Winner: In the event of a prize forfeit or disqualification of the original winner, The Competition Hive may award the prize to an alternate winner. This alternate will typically be determined by re-drawing from the remaining eligible entries (either by conducting a fresh random draw or by taking the next name/number on a drawn list, depending on the method originally used). The alternate winner will then be notified and the claim process as above will apply. Only one alternate draw will usually be done; we will make reasonable efforts to ensure a prize is awarded to a valid winner. If despite alternate attempts a prize remains unclaimed, we may decide not to award it (e.g., donate it to charity or use it in a future competition), subject to any necessary regulatory guidance.

  • Identity Verification: Before delivering any prize, The Competition Hive will verify the winner’s identity and eligibility. This means we will ask the winner to provide proof of age (18+) and residency (UK address), and possibly proof of identity (such as a passport or driver’s license) matching the name on their account. This is to prevent fraud and ensure compliance. We may also require the winner to answer the original Skill Question again or confirm their answer (as an anti-fraud measure, since only the legitimate entrant would know what answer they gave). If the winner fails to provide required verification information within a reasonable time or if we suspect fraud or ineligibility, the Promoter reserves the right to withhold the prize and disqualify that person, then select an alternate winner as above.

  • Prize Acceptance Form: For certain high-value prizes, winners may be asked to sign a simple Prize Acceptance Agreement or release form. This might cover acknowledgment of receipt, agreement to any publicity, and a liability release for the Promoter. We will make this process as straightforward as possible. Refusal to sign necessary acknowledgment forms may be treated as a failure to claim (though we would discuss with the winner in good faith).

  • Winner Communication: After confirming as a winner, you’ll coordinate with us on prize fulfillment (see Section 8 on how prizes are delivered). We will keep in touch via email/phone to ensure you receive your prize. Please note that by accepting the prize, you are not obliged to engage in any promotional activities (unless you consent), but we appreciate if winners share feedback or a photo with their prize, etc. (voluntarily).

  • Publication of Winners List: In accordance with UK advertising rules, The Competition Hive may be required to publish or make available a list of winners for our competitions, to demonstrate that prizes are awarded legitimately. This typically includes the winner’s surname and county (or general location)asa.org.uk. Section 11 (Publicity) below covers how we handle this and your options. Typically, we will not publish personal contact details – just a name and area – and only if necessary for transparency.

Our goal is to successfully award every prize to its winner in a timely manner. We ask entrants to help by keeping their details updated and responding promptly if contacted. If you suspect you might have missed a notification (e.g., you see on the Website that you won but didn’t get an email), please contact us at admin@competitionhive.co.uk so we can resolve it. The Competition Hive is not responsible for any winner who fails to check their email or other contact points and thus misses the claim window, as long as we have adhered to the notification procedure described. We will, however, always try our best to get in touch with winners because we want prizes delivered as much as you do!

10. Data Protection and Privacy

The Competition Hive is committed to protecting your personal data and handling it in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. This section outlines how we collect, use, and protect your information when you participate in our Competitions:

  • Personal Data Collected: When you register and enter Competitions, we collect personal information such as your name, email address, postal address, phone number, date of birth, and payment details. We also record your competition entries (including your answers to skill questions and any correspondence). If you win, we may collect additional information needed for prize fulfillment (e.g., delivery address confirmation, identification documents).

  • Purpose of Collection: We use your personal data to administer the Competitions – for example, to process your entries and payments, to verify eligibility, to select and contact winners, and to deliver prizes. Providing this information is necessary for the performance of the contract (your entry into the Competition). If you refuse to provide required data, we may not be able to enter you into the Competition or award a prize if you win.

  • Legal Basis: Our legal bases for processing your data include: Contractual necessity (to fulfill our obligations to run the competition and provide prizes to winners), Legitimate interests (to ensure the competitions are run fairly and to prevent fraud, as well as to market our services to those who have shown interest, within reasonable expectations), and in some cases Consent (for example, if you opt in to receive marketing emails, or consent to publicity – see Section 11). If we rely on consent, you have the right to withdraw it at any time.

  • Storage and Security: All personal data is stored securely by The Competition Hive and/or our data processors. We implement appropriate technical and organizational measures to protect against unauthorized access, loss, or alteration of your data. For example, our website uses SSL encryption for transactions, and user passwords are stored hashed. Only authorized personnel can access entrant data, and solely for the purposes outlined.

  • Data Sharing: We treat your information with care and confidentiality. We do not sell personal data to third parties. We may share your data with certain third parties strictly as needed for competition administration, such as: payment processors (to handle entry payments securely), email service providers (to send notifications), IT support or hosting providers, and delivery/courier services (to ship prizes). All such partners are bound by data processing agreements and must only use the data as instructed by us, consistent with these Terms and the law. Additionally, we may be required to share information about winners (e.g., name and county) publicly or with regulators (see Section 11 on winners’ list obligations)asa.org.uk. If you explicitly agree to additional publicity or marketing, we may share limited info (like your first name or photo) on our social media or website, but only with your consent. Lastly, we might disclose personal data if required by law or lawful authorities (for example, to comply with a court order or a request from the Advertising Standards Authority or Gambling Commission).

  • Data Retention: We will retain personal data for as long as necessary for the purposes of running the Competitions and for a reasonable period thereafter. If you create an account, we keep your basic account info until you request deletion or it’s no longer needed. Entry records may be kept for a certain time (e.g., 24 months) after the end of a Competition in case of any disputes, queries, or regulatory investigations, and to maintain a winners list as required. Financial transaction records are kept as required by financial regulations (typically 6 years). When data is no longer needed, we will securely delete or anonymize it.

  • Your Rights: Under UK data protection law, you have rights regarding your personal data. These include the right to access (you can request a copy of the data we hold about you), right to rectification (to correct any inaccurate or incomplete data), right to erasure (to request deletion of your data, though this is not absolute and may be limited if we need to keep data for legal reasons), right to restrict processing, right to data portability, and right to object to certain processing (for example, you can object to marketing use of your data, or to publication of your info as a winner – see Section 11). To exercise any of these rights, please contact us at admin@competitionhive.co.uk. We will respond in accordance with legal requirements. Typically, providing information or fulfilling rights requests is free of charge and done within one month.

  • Marketing Communications: We may use your contact details to send you updates about new competitions, special offers, or related marketing messages only if you have opted-in to receive such communications (for instance, by ticking a subscription box during account registration or entry). You are under no obligation to opt in, and your chances of winning are not affected by your marketing preferences. If you do opt-in, you can unsubscribe at any time by clicking the unsubscribe link in emails or contacting us. We will then stop sending you marketing, though we may still send transactional or service emails (like entry confirmations or important notices about a competition you entered).

  • Cookies and Website Data: Our Website uses cookies and similar technologies to function and to enhance user experience. These may collect some data about your device or browsing. For details, please see our Privacy Policy or Cookie Policy (if provided on the Website). By using the site, you consent to such usage as described there.

  • Privacy Policy: These Terms include key privacy information in the context of competitions, but for a more comprehensive description of our data handling, please refer to The Competition Hive’s Privacy Policy (available on our Website). Where there is any discrepancy, the Privacy Policy will elaborate on how we protect your data. By entering, you acknowledge that you have read (or have the opportunity to read) our Privacy Policy.

  • Data Protection Contact: The Competition Hive is the data controller for the personal data processed. If you have any questions or concerns about how your data is used, or if you want to make a complaint about privacy, you can contact us at admin@competitionhive.co.uk. We will do our best to address any issue. You also have the right to lodge a complaint with the UK’s supervisory authority for data protection, the Information Commissioner’s Office (ICO), if you believe your data is being mishandled.

By entering our Competitions, you agree to the collection and use of your personal data as described above. We take privacy seriously and will never use your information in ways unrelated to the operation of our site and competitions without your explicit consent.

11. Publicity and Winners’ Information

The Competition Hive may request or require limited publicity involvement from entrants and winners, in a manner consistent with UK laws and advertising regulations. This section explains how winners’ details may be used and published, and your choices:

  • Winner Announcement (Publicity): If you win a Competition, The Competition Hive intends to announce you as the winner on our Website and/or social media pages. Typically, we will publish your first name, the first letter of your surname (or surname in full, depending on context), and general location (e.g., city or county) as part of a winners announcement. For example, we may say “Congratulations to Jane D. from London, who has won [Prize] in our latest competition!”. We believe this level of information does not overly compromise your privacy while assuring other entrants that a real person won (and is roughly identifiable). This is a common practice and is generally allowed under data protection law as being in our legitimate interests and required by advertising rulesasa.org.uk. By accepting these Terms, you agree that we may publish such limited information if you are a winner.

  • Winners List Requirements: The UK Code of Non-broadcast Advertising (CAP Code) and the Advertising Standards Authority (ASA) rules require that promoters either publish or make available on request information indicating that a valid prize award took place for major prizesasa.org.uk. This usually means we must be able to provide (to anyone who asks, or via our website) the surname and county of residence of winners, and if applicable, the winning entry (e.g., the correct answer or entry number). Before you enter or at the time of entry, we are informing you of this requirement (hence this clause). After a Competition has ended, we may share the winner’s surname and county with participants who request winner details, or we might post it on a “Winners” page. If you object to your surname and county being made public, you must notify us (see below).

  • Opt-Out of Publication: We understand that some winners may desire privacy. If you do not wish for your surname and/or county to be published or made available on request, please contact us at the point of being informed that you have won (or beforehand). You may request that we either withhold this information or reduce the detail (for instance, we could use an initial or omit the county). Note: Even if you object to such disclosure, we may still be required to provide your information (full name and county) to the ASA or other regulators if challenged, to demonstrate that a valid award took placeasa.org.uk. We will not publish more information than required – usually just name and area – and will not include personal contact info.

  • Photographs and Media: The Competition Hive may ask winners to participate in reasonable publicity related to the Competition. This could include providing a photo or short video clip of you with your prize, or allowing us to take such a photo when delivering the prize. We might also request a brief quote or testimonial about your experience. There is no obligation to agree to extensive publicity beyond the basic winner announcement; however, it can be fun and beneficial for both parties. If you do provide photos or media to us, you agree that we can use those on our Website, social media, and marketing materials to promote our Competitions (for example, showing happy winners). We will always ask for your explicit consent before using any image or detailed story involving you. If you prefer not to be photographed or not to have your image public, that is absolutely fine and will not affect your prize.

  • Use of Name and Likeness: By entering a Competition, you grant the Promoter the right, if you are a winner, to use your name (in abbreviated form) and general location for the purpose of announcing the result of the Competition and for related promotional purposes. This is a condition of entry to meet transparency obligations and is supported by our legitimate interests in promoting our services. We will not use your full identity for marketing without permission. With your consent, we may additionally use your likeness (e.g., a photo of you) and any statements you’ve made about winning for publicity. This consent is separate and not required to receive the prize – you can decline any photo-op or interview and we will respect your choice.

  • No Undue Invasions: We will not release any excessive personal information about winners. For example, we will never publicize your full address, email, or phone number. We won’t tag you on social media or reveal your social media profile without consent. Our publicity will be limited to what is reasonable to show the competition had a real winner and to share the winner’s joy with our community.

  • Public Relations and Media Coverage: In some cases, a major win might attract media attention (especially if it’s a large cash prize or a unique experience). The Competition Hive will never give the media your personal details without your agreement. If press requests come, we might reach out to you to see if you are interested in speaking to them or sharing your story, but again, this is voluntary.

  • Consent Withdrawal: If you initially agree to any publicity and later change your mind, contact us and we will cease future use. However, please note that once certain information or images are published (especially on the internet), we cannot always retract them fully if third parties have shared or cached the content. We will do our best to honor any withdrawal of consent on a forward-going basis.

  • Promotion of the Site: The Competition Hive may use anonymized or aggregated information about competition outcomes for marketing (e.g., “Over 100 winners in the past year, prizes totaling £50,000 given away!”). This does not personally identify individuals but highlights the success of competitions. We may also highlight specific prize awards in advertising, but as per above, will only identify winners by first name and general location unless further detail is agreed.

  • Social Media: If you engage with us on social media (e.g., commenting on our posts about a competition or tagging us in a winner’s post), we may re-share that content on our pages. By interacting in those ways, you’re implicitly consenting to that content being public. We encourage a friendly and respectful community; any offensive or inappropriate public posts can be removed or hidden by us.

In summary, by entering, you allow The Competition Hive to use your name and county as required to comply with winner disclosure rulesasa.org.uk and moderate publicity. We greatly appreciate the cooperation of winners in sharing their excitement, but we also respect privacy concerns. If you have strong preferences about publicity, please communicate with us – we will find a suitable approach that meets legal requirements and your comfort level.

12. Limitation of Liability

By participating in The Competition Hive’s Competitions, you agree that, to the fullest extent permitted by law, the Promoter’s liability to you is limited. Please read the following carefully:

  • Non-Excludable Liability: Nothing in these Terms seeks to limit or exclude The Competition Hive’s liability for: death or personal injury caused by our negligence, or that of our employees or agents; fraud or fraudulent misrepresentation; or any other liability which cannot be lawfully limited or excluded under UK law. Your statutory rights as a consumer are not affected by these Terms.

  • Exclusion of Indirect Loss: Subject to the above, The Competition Hive will not be liable for any indirect, special, or consequential losses incurred by any entrant or winner in connection with participation in a Competition or use of a prize. This means we are not responsible for losses that were not foreseeable to both you and us at the time you agreed to these Terms. For example, we won’t cover any lost income, business profits, anticipated savings, or other such economic loss, nor any personal disappointment or emotional distress arising from not winning or from issues with a prize. Competitions are games of chance (after the skill requirement) and by nature there will be many non-winners; entering is at your own risk for the chance to win.

  • Cap on Liability: To the extent permitted by law, the Promoter’s total liability to any Entrant for any claim arising out of or relating to a Competition or these Terms (whether in contract, tort (including negligence), or otherwise) is limited to the amount of the entry fees paid by that Entrant for the relevant Competition. If your claim relates not to a specific Competition but to use of the Website generally, our liability shall be limited to £100. We consider this fair given the low price of entry and the optional nature of participation.

  • Website and System Availability: The Competition Hive is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, providers, website platform, equipment, software, failure of any email or entry to be received due to technical problems or traffic congestion on the internet, or any combination thereof. No liability is accepted for any entries that are lost, delayed, misdirected, corrupted, or not received for any reason beyond our reasonable control. If technical issues disrupt a Competition entry process or draw, we reserve the right to suspend, extend, or cancel the Competition as appropriate (with notice).

  • Viruses and Damage: We do not guarantee that our Website will be secure or free from bugs or viruses. It is your responsibility to use your own virus protection software. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your device due to your use of our Website or downloading of any content.

  • Disqualification and Breach: The Promoter will not be liable to you for any loss or damage arising from our exercise of our rights to disqualify or exclude you (or your entries) as a result of your breach of these Terms. For example, if we disqualify your entry because you answered the question wrong or violated eligibility rules, we are not responsible for any loss of chance or expense you incurred. It is your responsibility to follow the rules; we administer them fairly to protect all participants.

  • Prizes Provided “As Is”: Except where expressly stated, prizes are provided “as is” at time of award. The Promoter does not make and expressly disclaims any warranty or representation as to a prize’s quality, fitness for purpose, or otherwise. We will, of course, pass on any manufacturer warranties and facilitate support to the extent possible, but we are not the manufacturer of the prize (unless the prize is cash). For experience prizes, we are not the operator of the experience and thus are not liable for their acts or omissions. Any legal recourse the winner may have regarding a prize must be against the manufacturer or provider, not the Promoter, though we will assist the winner in good faith to resolve issues.

  • No Liability for Participant’s Conduct: We are not liable for any damage or loss you cause by your participation in the Competition. You agree not to sue or hold us responsible for actions of other entrants or any third parties. If, for instance, entrants post content online or communicate in relation to a Competition, we are not responsible for what they say or do.

  • Force Majeure: The Competition Hive will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms (including hosting a Competition or delivering a prize) that is caused by events outside our reasonable control. Such events may include, but are not limited to, acts of God, war, terrorism, epidemic/pandemic, network or power failures, or any law or action taken by a government or public authority. In such circumstances, we will do our best to keep you informed and will take reasonable steps to minimize disruption, which may include postponing or cancelling a Competition if necessary (with refunds as applicable).

  • Release of Liability: By entering, you agree to release and hold harmless The Competition Hive and its owners, directors, employees, and agents from any and all liability, claim, or action of any kind arising out of your participation in the Competition, use of the Website, or the acceptance, possession, or use of any prize, except to the extent that any liability arises from our own intentional misconduct or fraud. This release includes, for example, any claims for injury or damage to persons or property (like if you trip on the way to collect a prize or if a delivered product prize malfunctions) that may be sustained in connection with the Competition or prize. If any third party claims that your actions (or submissions) in the Competition violate their rights, you will indemnify the Promoter against any damages arising.

  • Legal Compliance: We conduct our Competitions in accordance with applicable laws and regulations. However, we make no representation or warranty that the Competitions are lawful in any specific non-UK jurisdiction (since we restrict to UK entrants). We shall not be held liable for any entrant participating unlawfully. It is your responsibility to ensure your participation is legal where you live (as noted in Eligibility).

  • Limitation Regarding Site Use: In addition to competition-specific terms, when using our Website, you agree that The Competition Hive will not be liable for any downtime, errors, or content inaccuracy on the Website. We strive for accuracy and availability but cannot guarantee it. If you find any issue on the site, please report it to us, and we will attempt to fix it, but we aren’t liable for losses caused by such issues.

By acknowledging these Terms, entrants accept that The Competition Hive’s liability is limited and that entering a Competition is at the entrant’s own risk. If you do not agree with this limitation of liability, please do not enter the competitions. The cost of entry is relatively small and the potential prizes large, and thus this allocation of risk is intended to be fair and reasonable.

13. Disqualification, Suspension, and Termination

The Competition Hive reserves the right to disqualify entries or entrants, and to suspend or terminate accounts or Competitions, in the circumstances outlined below:

  • Disqualification of Entries: An entry may be disqualified (removed from the competition and made ineligible to win) if, at any point, we discover or reasonably suspect that:

    • The entry does not comply with these Terms or the specific competition rules.

    • The Entrant was ineligible to enter (e.g., underage, non-UK resident, etc.) or provided false information during signup or entry.

    • The Entrant answered the Skill Question incorrectly, making the entry invalid (as per Section 6).

    • Payment for the entry was chargebacked, reversed, or not honoured (e.g., a credit card payment that is later disputed or fails).

    • The entry was made through automated means or via a script/bot (Section 2, No Bots).

    • There is evidence of collusion or syndication (multiple individuals coordinating to unfairly increase chances or circumvent entry limits) or any form of cheating.

    • The entry itself is somehow corrupted or not properly received (e.g., incomplete information) and cannot be rectified.

    • The Entrant’s behavior is unlawful, or they tampered with the administration of the Competition (such as hacking the site).

Disqualified entries are not eligible to win and will not be included in the draw. The Promoter is not obliged to notify an entrant at the time of disqualification (though significant cases like suspected fraud might be communicated). We may, at our discretion, remove a disqualified entry from entry lists or mark it as void.

  • Disqualification of Winners: We may refuse to award a prize and disqualify a winner after a draw if:

    • The winner is found to have been ineligible or in breach of these Terms at the time of entering.

    • The winner fails to provide required verification or is found to have provided false identity/address.

    • The winner is found to have used multiple accounts or otherwise circumvented the entry rules to gain unfair advantage.

    • The winner is in a jurisdiction that was not permitted (though we aim to prevent that at entry stage).

    • We discover any fraudulent or dishonest conduct by the winner that affects the competition’s integrity.

In such cases, the prize will be forfeited and an alternate winner will be drawn as described earlier. The initial winner will have no claim to the prize once disqualified. The Promoter’s decision on this is final.

  • Account Suspension/Termination: The Competition Hive may suspend or terminate your user account on the Website if we believe you have violated these Terms or engaged in any misconduct. Misconduct includes harassing or abusive behavior towards our staff or other participants (for example, offensive comments on social media, see Lucky4U example where harassment leads to disqualificationlucky4ucompetitions.co.uk), attempts to scam or defraud the Promoter or other users, or any illegal activities. We will typically issue a warning for minor violations, but for serious breaches, account termination can be immediate. If your account is terminated, you may be barred from future use of the site and entering any Competitions. Any entries you have at the time of termination may be voided at our discretion (with refunds given if appropriate, e.g., if you had valid entries that were not in violation, we might refund those rather than let you continue).

  • Competition Cancellation: In extreme cases where the integrity of a Competition is compromised (for example, a technical failure that cannot be rectified, or evidence of widespread fraud/cheating), we may cancel the Competition entirely. If cancellation occurs, we will inform all entrants and issue appropriate refunds of entry fees. Cancellation would be a last resort, undertaken to maintain fairness and legal compliance.

  • Breach of Terms: Any breach of these Terms by an Entrant may result in exclusion from the competition and possibly future competitions. The Promoter reserves the right to seek legal remedies in cases of serious fraud or abuse (for example, if someone attempts to hack the site or commits credit card fraud, we may report to law enforcement).

  • Fair Play: We expect all participants to play fairly. These rules on disqualification and termination are in place to protect genuine entrants and the credibility of our Competitions. If you have any concerns that another entrant is cheating or notice any suspicious behavior, you can report it to us at admin@competitionhive.co.uk and we will investigate. We will handle such reports confidentially.

Ultimately, while we have to spell out these consequences, we hope never to use them. The vast majority of our entrants will enjoy the competitions in good faith. We just need to ensure a level playing field for everyone. The Promoter’s decisions regarding disqualification and account actions are final and made in the interest of fairness and compliance.

14. General Provisions

This section includes miscellaneous but important terms that govern your relationship with The Competition Hive while using the Website or participating in Competitions:

  • Entire Agreement: These Terms and Conditions (along with any specific rules or instructions stated for individual competitions, and any other documents expressly incorporated by reference, such as our Privacy Policy) constitute the entire agreement between the Promoter and you, the Entrant, regarding the Competitions and use of the Website. They supersede any earlier statements or agreements (whether oral or written) relating to the subject matter. You acknowledge that you have not relied on any representation or information not contained in these Terms in deciding to enter a Competition.

  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or competent authority, that provision shall be deemed severed from the rest of the Terms and the remaining provisions shall continue in full force and effect. In such case, the invalid or unenforceable provision will be interpreted, if possible, in a manner that most closely matches the intent of the original provision within the limits of the law.

  • Amendments: The Competition Hive may update or modify these Terms from time to time, for example to reflect changes in law, regulatory guidance, or our business practices. When we do so, we will post the revised Terms on the Website with an updated “last modified” date. For significant changes, we may also notify registered users via email or a site notice. It is your responsibility to review the Terms before entering a new Competition. If you continue to use the Website or enter competitions after Terms have changed, you will be deemed to have accepted the updated Terms. If you do not agree to the changes, you should stop using the site and refrain from entering further competitions.

  • No Waiver: Any failure or delay by the Promoter in enforcing any provision of these Terms does not constitute a waiver of that provision or of any other provision. Our rights or remedies under these Terms remain available even if we do not strictly enforce them at every instance. Any waiver of a breach of these Terms will only be effective if in writing and signed by the Promoter, and will not be considered a waiver of any later breach.

  • Assignment: You may not assign, transfer, or subcontract any of your rights or obligations under these Terms to any other person without our prior written consent. The Promoter may transfer its rights and obligations under these Terms to another entity (for example, if the business is sold or merged) but will notify you in such an event and ensure that this will not affect your rights under the Competitions.

  • Third-Party Rights: These Terms are between you and The Competition Hive. Except as required by law, no third party shall have any rights to enforce any term of this agreement (except that if a prize is provided by a third-party sponsor, that sponsor may rely on the disclaimers and liability limits as if it were the Promoter). The Contracts (Rights of Third Parties) Act 1999 shall not apply except where expressly stated.

  • Governing Law: These Terms and any dispute or claim arising out of or in connection with them or any Competition (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. This means the interpretation of the Terms and all legal issues will be determined by English law.

  • Jurisdiction: You agree that any disputes or claims arising between us shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may alternatively choose the courts of your home country for jurisdiction. The Promoter will not claim that a court in another country has jurisdiction over a dispute with a UK consumer. We encourage resolving any concerns or disputes informally by contacting us first (we truly value our entrants and will do our best to sort out any genuine problems fairly).

  • Complaints and Queries: If you have a question, feedback, or complaint about a Competition or these Terms, please contact us (details below). We take complaints seriously and will acknowledge and respond to you as soon as possible. If a dispute arises that we cannot resolve together, you may have the right to seek remedies through consumer dispute resolution mechanisms or small claims court, etc., under applicable law.

  • No Relationship: Participation in a Competition or use of the Website does not create any form of legal partnership, joint venture, employment, or agency relationship between you and the Promoter. You are simply an entrant or user, and we are the operator of a promotional competition. You cannot speak for or bind The Competition Hive in any way by virtue of entering.

  • Intellectual Property: All website content, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of The Competition Hive or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not use any trademark, logo, or content from our site for any commercial purpose without our express written consent. Entering a competition does not grant you any rights to our intellectual property or that of any prize manufacturers. (Note: Any third-party trademarks or brand names of prizes belong to their respective owners; The Competition Hive is not affiliated with or endorsed by those brands unless explicitly stated, and use of their names is only to describe the prizes).

  • Headings: Section headings in these Terms are for convenience of reading only and do not affect interpretation. The bold summaries or titles are not substantive parts of the Terms but are there to help guide you.

  • Translations: These Terms are provided in English. If we provide any translation, the English version will prevail in case of any inconsistency.

  • Acceptance: By checking the acceptance box during registration or entry, or by entering any Competition, you indicate that you have read and agree to these Terms and Conditions. If you are reading a printed copy of these Terms, your participation in the Competition is deemed acceptance. If you require any clarification on these Terms, please contact us prior to entering.

Thank you for participating in The Competition Hive’s competitions. We strive to run fun, fair, and lawful promotions. Good luck, and enjoy the excitement of the competitions!
